Strip Club Airlines Travel Information

Public Charter Operator Participant Agreement

This Operator-Participant Agreement sets forth the terms and conditions under which StripClubAirlines, in return for payment of the amount indicated as the total charter price, agrees to provide to each participant (the "Participant" or "Passenger") participation in a charter flight (the "Charter Flight") operated by or through StripClubAirlines. The Department of Transportation requires all passengers to agree/accept/sign the terms of the Operator Participant Agreement prior to departure.

Responsibility
StripClubAirlines, as the principal, is responsible to the Participant for arranging and providing public charter air transportation (charter flights). Neither StripClubAirlines, nor its agents, servants, employees, or your travel agent assumes responsibility for, and the Participant agrees to release, relieve and hold harmless StripClubAirlines from, any claim, action, cause of action, injury, losses or damages arising from the actions of third-party contractors supplying services, including missed connections, lost or stolen items or baggage, costs or expenses arising out of injury, accident or death, quarantine, disturbances, governmental restrictions or regulations, damage, delay of baggage or other property, inconveniences, loss of enjoyments, loss, disappointment, mechanical breakdown, airport closure, air traffic control restrictions, government action, strike, lockouts, war, terrorism, weather, acts of God, force majeure, or other factors or cause beyond its control.

Reservations And Payment
Charter Reservations may be made directly by calling StripClubAirlines or through this website at StripClubAirlines.com. Full payment is due at time of booking of the flight. Passengers have a right to a copy of this Agreement prior to making payment. For bookings made by calling StripClubAirlines or via the internet, credit card payments are accepted only and are accepted and processed automatically. Otherwise, checks or money orders must be made payable to StripClubAirlines, unless the charter is purchased through a travel agent, in which case the Passenger may make payment to the travel agent and the travel agent, in turn, must make their check payable to the escrow account at the depository bank.

Charter Price
The quoted charter price includes charter air transportation for the Charter Flight booked with StripClubAirlines reservation department or via the internet. Fares do include 7.5% Federal Excise Tax. Not included are Federal Excise Tax Segment Fees, Passenger Facility Charges (PFC), Security Charges, and September 11th Security Fees totaling up to $10 each way. The Passenger is responsible for all incidental expenses during the Charter Flight. Infants under two (2) years of age may occupy the same seat as a fare-paying passenger at no additional charge. StripClubAirlines accepts one infant per paying passenger on each Charter Flight. Except for major changes as described below, no refund will be made for services included in the Charter Flight price which are not used. Excess baggage, unaccompanied minor fees, and change fees are not included in the Charter Flight price. Please contact StripClubAirlines for these charges.

Passenger Cancellations, Changes Of Dates And Refunds
The price of tickets for Charter Flights is non refundable. Reservations may be changed or cancelled to receive credit towards a future Charter Flight, subject to availability, for a fee of $50 per Passenger. Cancellations result in a flight credit which may be used for travel on Charter Flights up to 365 days from date of original travel, in the amount of the Charter Flight price, less the applicable cancellation fee. The right to a refund if a Charter Flight is changed is limited but; include the following rights: a) Participants who pay by a credit card may receive a full refund until a operator-participant contract is signed. b) Participants may receive a full refund, less a $25 administrative fee, upon providing a substitute Participant to StripClubAirlines or upon StripClubAirlines finding a substitute for you. StripClubAirlines reserves the right to accept or decline a Passenger as a Participant of a Charter Flight or to change or withdraw a Charter Flight, subject to the provisions in this Agreement regarding major changes or cancellations by the operator. To request a refund, a Participant must submit a request in writing. Refunds will be made within 14 days after cancellation or substitution.

Baggage
StripClubAirlines will transport free of charge a maximum of three (3) bags: 1) up to two (2) bags may be checked free of charge, each piece not exceeding 50 pounds, with a total combined weight not to exceed 70 pounds, and which dimensions not to exceed 62 inches in overall length, width and height. 2) One (1) carry on bag not to exceed overall dimensions of 36 inches, plus a personal item such as a purse, laptop, backpack, diaper bag or camera case. Overweight and/or oversize bags require a $50 fee for each. Special items such as surfboards, bicycles, scuba equipment are not included with customers free baggage allowance and are subject to an extra charge. Golf bags are accepted free of charge as one of the two (2) free checked bags and must be sealed at top. Excess baggage will be accepted on a space available basis only, as determined by StripClubAirlines in its sole determination. All bags must have outside identification. StripClubAirlines does not accept pets in the cabin or in the cargo space on Charter Flights. Liability for lost, stolen, pilfered, or damaged bags is limited to $2,500 (provided the Passenger provides StripClubAirlines with the baggage claim check and suitable evidence of the value of the bag and it contents). No liability for the following items in checked baggage: electronic equipment, musical instruments, photos, rugs and photographic, recreational, camping, mechanical or sports equipment, business documents, edible or perishable items including fruits, medicines, drugs, toiletries and cash and other negotiable instruments. Any baggage claims must be reported to the StripClubAirlines ticket counter prior to leaving the airport or are waived by the Passenger.

Customer Service
StripClubAirlines is committed to quality service. In the unlikely event that you have cause for dissatisfaction during a Charter Flight, the Passenger should call Customer Service to discuss the problem with a Customer Service Representative or e-mail StripClubAirlines at CustomerService@StipClubAirlines.com. If, after discussing the matter with a Customer Service Representative of StripClubAirlines, the Passenger believes the Passenger still has a valid complaint, the Passenger should send a written account of the complaint to StripClubAirlines within 30 days of the return of a Charter Flight. StripClubAirlines will not process any complaints unless such complaint is in writing and received within the 30 days.

Check-In
Check-in is available two (2) hours prior to flight time. All Passengers must check-in no less than one hour prior to the scheduled departure time of a Charter Flight. StripClubAirlines reserves the right to resell any seat 30 minutes prior to departure that have not checked-in, and the Passenger will have no claim against StripClubAirlines for such canceled reservation. Failure to check-in prior to one hour prior to scheduled departure time will result in an automatic cancellation of the Passenger's reservation and a 100% penalty applies. Participants will not receive refunds for missed flights or connections. All Passengers must be present at the boarding gate at least 20 minutes prior to departure; failure to do so may result in denial of boarding. All passengers 18 years of age or old must have valid government issued photo identification, drivers' license or passport. Any Passenger that exhibits disruptive behavior will not be allowed to board, or will be removed from the flight. Federal Law permits penalties to include substantial fines, imprisonment or both.

Air Transportation
All flights are operated as public charters for StripClubAirlines. StripClubAirlines reserves the right to substitute scheduled aircraft when necessary at no additional cost and at comparable departure times based on participation in the charter program. The Passenger will be notified of any such decision no less than ten days prior to departure and may either accept the scheduled service or request a full refund within seven days of receipt of notification. StripClubAirlines also reserves the right to substitute another air carrier or to change the aircraft type or capacity and does not guarantee single plane stop service. No refunds or compensation will be given for such substations or changes.

Major Changes
If StripClubAirlines makes major changes prior to departure, the Participant shall have the right to cancel the reservation on the Charter Flight and receive a full refund. The following are major changes: (1) a change in the origin or destination city of a Charter Flight, unless the change is only the order in which cities the cities are flown; (2) a change in the departure or return date of a Charter Flight unless the change results from a flight delay experienced by StripClubAirlines of greater than 48 hours; or (3) a Charter Flight price increase of more than 10% occurring ten or more days before departure of the Charter Flight. In no event may StripClubAirlines change the Charter Flight price less than ten days prior to departure of the Charter Flight. If a major change must be made in a Charter Flight, StripClubAirlines will exercise all reasonable commercial diligence to notify the Passenger within seven days after first of such major change, but in any event at least 10 days before schedule departure of the Charter Flight. If a major change occurs less then 10 days before the scheduled departure, of a Charter Flight, StripClubAirlines will notify the Passenger as soon as possible. Within seven days after receiving notification of a major change, but in no event later than departure, the Passenger may cancel such Passenger's reservation by written notice to StripClubAirlines and will receive a full refund within 14 days after such cancellation. When a major change occurs after departure of the Charter Flight which the Passenger is unwilling to accept, StripClubAirlines will refund to the Passenger, within 14 days after the scheduled return date of the Charter Flight, that portion of the price for such Charter Flight that applies to the services not accepted. StripClubAirlines has no right to cancel a Charter Flight less than 10 days before the scheduled departure date, except for circumstances that make it physically impossible to perform the Charter Flight or causes beyond its control. If StripClubAirlines must cancel the Charter Flight 10 or more days before departure, StripClubAirlines will notify the Passenger in writing within seven days of cancellation, but in any event at least 10 days before the scheduled departure date of the Charter Flight. If StripClubAirlines must cancel the charter less than ten days before the scheduled departure (i.e. for circumstances that make it physically impossible to perform the charter trip or for causes beyond its control), StripClubAirlines notify the Passenger as soon as possible and a refund will be made to the participant within fourteen days after the cancellation.

General
The rights and remedies made available under this Agreement are in addition to any of the right and remedies available under New York law. The acceptance by a Participant of a refund, or alternative travel arrangements, as provided in this Agreement shall constitute a full and final settlement and release of all other claims or remedies against StripClubAirlines. By executing this Agreement, the Participant specifically acknowledges and consent to all conditions set forth herein. This Agreement contains the entire agreement between the parties and completely supercedes any prior agreements or representations of StripClubAirlines, verbal or in writing. This Agreement can be amended only in writing in a document signed by both parties. Any oral representation or modifications shall have no force or effect. New York law shall govern this Agreement. Any claim against StripClubAirlines must be presented in writing within 30 days of the date of the return flight of a Charter Flight, and StripClubAirlines shall have no obligations or liabilities for any claims presented after said 30 period.
